Terms of Use

Please read these terms carefully before using VinScanPro. They govern your access to our reports, subscriptions, and all services.

Welcome to VinScanPro. These Terms of Use, together with any documents, policies, disclosures, or supplemental terms incorporated by reference, govern your access to and use of the website located at vinscanpro.com, including any related pages, dashboards, checkout flows, vehicle history reports, VIN lookup tools, VIN decoding tools, subscription services, account features, software, data displays, AI-powered analysis features, customer support channels, and any other products or services made available by us from time to time. For purposes of these Terms, "VinScanPro," "Company," "we," "us," and "our" refer to Kaelric Dynamics LLC, doing business as VinScanPro, and its owners, officers, directors, managers, members, employees, contractors, vendors, licensors, data providers, affiliates, successors, and assigns. If the operating legal entity changes, these Terms shall apply to the successor or assigned entity operating the Services. By accessing, browsing, creating an account, submitting a VIN, purchasing a report, starting a trial, subscribing, using any dashboard, viewing any report, or otherwise using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, our Refund Policy, and all applicable posted disclosures. If you do not agree to these Terms, you must not access or use the Services.

01.Binding Agreement

These Terms constitute a legally binding agreement between you and VinScanPro. You agree that your use of the Services is voluntary and that you are responsible for reviewing these Terms before using the Services. You may not use the Services if you are legally prohibited from doing so, if you are under the age required by these Terms, or if you are using the Services on behalf of another person or entity without authority. If you use the Services on behalf of a company, dealership, repair shop, inspection business, marketplace seller, lender, fleet operator, or other entity, you represent and warrant that you have authority to bind that entity to these Terms. In that case, "you" and "your" refer to both you personally and the entity on whose behalf you use the Services.

02.Changes to These Terms

We may update, modify, replace, or revise these Terms at any time. When we make changes, we may update the "Last Updated" date, post a notice on the website, send an email, display an in-account notification, or use another reasonable method of notice. Unless otherwise stated, updated Terms become effective when posted. Your continued use of the Services after updated Terms become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, your sole remedy is to stop using the Services and cancel any active subscription before the next renewal date.

03.Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services. By using the Services, you represent and warrant that:
  1. 1You are at least 18 years of age;
  2. 2You have legal capacity to enter into these Terms;
  3. 3All information you provide to us is accurate, current, and complete;
  4. 4You will use the Services only for lawful purposes;
  5. 5You will comply with all applicable laws, rules, and regulations;
  6. 6You will not use the Services in any manner that violates these Terms.
We reserve the right to request information to verify your identity, account ownership, billing authorization, or lawful use of the Services.

04.Description of the Services

VinScanPro provides vehicle-related information tools, which may include VIN decoding, vehicle history reports, title and brand information, accident or damage indicators, odometer-related information, salvage or total-loss indicators, theft-related indicators, specifications, recall information, market-related information, ownership-cost estimates, risk indicators, and other vehicle-related data where available. The Services may also include AI-powered or algorithmic analysis features, including but not limited to "Smart Buy Analysis," "Decision Engine," "Deal Radar," risk summaries, recommendation-style outputs, vehicle scoring, affordability or ownership-cost estimates, and similar features. The Services are intended to help users review available vehicle-related information. The Services are not a substitute for independent inspection, professional advice, state DMV records, mechanic review, title verification, lien verification, legal advice, insurance advice, financing advice, tax advice, safety inspection, or personal judgment.

05.Vehicle Data Is Not Guaranteed

You understand and agree that vehicle history information is based on data received from third-party, public, private, government, commercial, industry, insurance, auction, salvage, repair, recall, title, and other sources that may vary by vehicle, state, provider, reporting entity, and time period. VinScanPro does not create, control, own, independently verify, or guarantee the underlying third-party data displayed in reports unless expressly stated otherwise. Reports may be incomplete, delayed, outdated, inaccurate, unavailable, duplicated, inconsistent, or missing important information. A "clean" report does not guarantee that a vehicle has no accidents, damage, defects, title problems, odometer issues, liens, theft history, safety issues, mechanical issues, prior commercial use, flood damage, structural damage, airbag deployment, frame damage, or other negative history. You are solely responsible for verifying any vehicle information before purchasing, selling, financing, insuring, repairing, registering, transporting, or otherwise relying on a vehicle.

06.No Substitute for Inspection or Official Records

A vehicle history report is not a physical inspection and cannot identify all vehicle conditions. We strongly recommend that you obtain an independent pre-purchase inspection by a qualified mechanic or inspection professional before buying any used vehicle. You should also verify title status, liens, registration status, emissions status, recall completion, odometer readings, and ownership records with the appropriate state DMV, seller, lender, manufacturer, dealership, mechanic, insurance carrier, or other official source. VinScanPro is not responsible for any decision you make based on a report, including a decision to buy, sell, finance, insure, repair, reject, value, transport, list, or negotiate a vehicle.

07.AI-Powered Analysis and Decision Features

Certain Services may use automated systems, algorithms, artificial intelligence, machine learning, rules-based analysis, statistical estimates, third-party data, and user-provided information to generate summaries, risk indicators, vehicle scores, recommendations, or decision-support content. All AI-powered outputs are provided for informational purposes only. They are not professional advice and should not be treated as definitive, complete, or guaranteed. You acknowledge and agree that AI-powered analysis may:
  1. 1Misinterpret data;
  2. 2Omit relevant facts;
  3. 3Produce incorrect, incomplete, or outdated conclusions;
  4. 4Be affected by missing or inaccurate third-party data;
  5. 5Use assumptions or estimates;
  6. 6Change over time as data, systems, prompts, models, or features are updated.
You are solely responsible for evaluating whether any vehicle is suitable for your needs. VinScanPro does not guarantee that any vehicle is safe, reliable, fairly priced, mechanically sound, legally transferable, insurable, financeable, or a good purchase. No AI-generated output should be relied upon as the sole basis for any vehicle-related decision.

08.No Professional Advice

The Services do not provide legal, financial, mechanical, tax, insurance, investment, valuation, safety, engineering, inspection, regulatory, or professional advice. Any price estimates, cost estimates, depreciation information, insurance-related estimates, repair-cost estimates, ownership-cost estimates, market comparisons, theft-risk indicators, reliability indicators, or similar content are informational estimates only. Actual costs and risks may vary significantly. You should consult qualified professionals before making decisions involving vehicle purchases, sales, repairs, financing, insurance, registration, title transfer, legal claims, or business operations.

09.Not a Consumer Reporting Agency; No FCRA Use

VinScanPro is not a consumer reporting agency and does not provide consumer reports as those terms are defined under the Fair Credit Reporting Act or similar laws. You may not use the Services, reports, data, AI outputs, vehicle scores, or any information obtained through VinScanPro to determine any person's eligibility for credit, insurance, employment, housing, tenancy, licensing, government benefits, or any other purpose regulated by the Fair Credit Reporting Act or similar consumer reporting laws. The Services are intended to provide vehicle-related information associated with a VIN or vehicle, not to evaluate any individual person. You agree not to use the Services to make decisions about any person's character, reputation, personal characteristics, creditworthiness, employment suitability, tenant suitability, insurability, or eligibility for any legally regulated benefit, product, or service.

10.Account Registration

To access certain Services, you may be required to create an account. You agree to provide accurate, complete, and current information and to update such information as needed. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately if you believe your account has been accessed without authorization. You may not:
  1. 1Create accounts using false information;
  2. 2Create multiple accounts to abuse trials, promotions, pricing, usage limits, or referral systems;
  3. 3Share, sell, rent, transfer, sublicense, or assign your account;
  4. 4Allow unauthorized users to access your account;
  5. 5Use another person's account without permission;
  6. 6Use disposable, fraudulent, or misleading account information.
We may suspend, restrict, or terminate accounts that we believe violate these Terms or present a security, fraud, payment, compliance, or abuse risk.

11.Payment Authorization

By purchasing a report, starting a trial, buying credits, subscribing, or otherwise submitting payment information, you represent and warrant that you are authorized to use the selected payment method. You authorize VinScanPro and its payment processors to charge your payment method for all amounts disclosed at checkout, including trial fees, subscription fees, renewal charges, taxes, usage charges, upgrades, add-ons, and any other charges you authorize. You agree to keep your billing information current and accurate. If your payment method fails, we may retry the charge, request updated payment information, suspend access, restrict report generation, cancel your subscription, or take other reasonable steps to collect amounts owed. All prices are stated in U.S. dollars unless otherwise indicated.

12.Trials, Promotions, and Automatic Renewal

VinScanPro may offer promotional trials, discounted trials, introductory offers, credits, coupons, or limited-time promotions. The specific trial price, trial length, renewal price, billing cycle, included usage, cancellation deadline, and other material terms will be disclosed at checkout or in the applicable offer. Unless otherwise stated at checkout, a trial automatically converts into a recurring paid subscription at the end of the trial period unless you cancel before the trial expires. By starting a trial, you authorize us to charge your payment method for the trial amount and, unless you cancel before the trial ends, the recurring subscription amount disclosed at checkout. Promotional offers are available only to eligible users and may be limited to one per person, payment method, household, device, IP address, business, or account. We may deny, revoke, suspend, or reverse promotional access if we determine that an offer has been abused, manipulated, duplicated, resold, or used in violation of these Terms.

13.Subscriptions and Renewal Billing

If you purchase a subscription, your subscription will continue and automatically renew until canceled, unless otherwise stated at checkout. You authorize us to charge your payment method on a recurring basis according to the billing cycle disclosed at checkout. Renewal charges may occur on or around the same calendar day of each billing period, subject to payment processor timing, banking delays, weekends, holidays, failed-payment retries, or other processing factors. Subscription access, available reports, credits, fair-use limits, features, and plan benefits may vary by plan and may change over time. Unless required by law or expressly stated in our Refund Policy, subscription fees are non-refundable once charged.

14.Cancellation

You may cancel your subscription through the cancellation method made available in your account dashboard or through another cancellation method expressly provided by VinScanPro. Cancellation takes effect at the end of the then-current paid billing period unless otherwise stated. You may continue to have access until the end of the paid period, subject to these Terms and any applicable usage limits. Deleting your account, logging out, failing to use the Services, removing a payment method, sending a general support message, initiating a chargeback, or uninstalling an app or browser does not automatically cancel a subscription unless the cancellation is completed through an approved cancellation method or confirmed by us in writing. If you are unable to cancel due to a technical issue, you must contact support@vinscanpro.com before your renewal date and include your account email, description of the issue, and reasonable evidence such as a screenshot. We may verify the issue and process cancellation where appropriate. You are responsible for canceling before the next renewal if you do not want to be charged.

15.Refunds

Refunds are governed by our Refund Policy, which is incorporated into these Terms by reference. Because VinScanPro provides digital services, data access, report generation, third-party data retrieval, and downloadable or viewable digital content, fees may become non-refundable once a report is generated, data is retrieved, credits are used, subscription access is provided, or the billing period begins, except where required by law or expressly stated in our Refund Policy. We may, in our sole discretion, issue credits, replacement reports, partial refunds, goodwill refunds, or other accommodations. Any such accommodation does not create an obligation to provide the same or similar accommodation in the future.

16.Credits, Reports, and Usage Limits

Certain plans may include report credits, usage allowances, fair-use limits, trial limits, or account-specific restrictions. A report, credit, lookup, or usage unit may be consumed when a VIN is submitted, a report is generated, a data request begins, a third-party provider is queried, or a report becomes available, depending on the applicable plan and system design. No credit, replacement, or refund is guaranteed merely because a report contains limited information, no negative history, incomplete records, unavailable records, unexpected results, or information you already knew. We may limit, suspend, or review usage that appears excessive, automated, commercial, abusive, fraudulent, or inconsistent with personal-use subscription terms. Trial, personal, or consumer subscriptions are not intended for high-volume business use, resale, automated lookups, dealership integrations, marketplace scraping, fleet processing, API use, bulk VIN processing, or data extraction unless expressly permitted in a separate written agreement.

17.Fair Use and Abuse Prevention

We may monitor account activity, usage patterns, VIN searches, payment activity, device information, IP addresses, reports generated, account creation patterns, and other information to detect abuse, fraud, security threats, unauthorized resale, excessive usage, trial manipulation, payment disputes, automated access, or violations of these Terms. We reserve the right to:
  1. 1Restrict report generation;
  2. 2Place an account under review;
  3. 3Require additional verification;
  4. 4Limit access to certain features;
  5. 5Suspend or terminate an account;
  6. 6Decline transactions;
  7. 7Cancel promotional access;
  8. 8Require migration to a commercial plan;
  9. 9Block devices, payment methods, IP addresses, domains, or accounts;
  10. 10Take any other reasonable action to protect the Services.
We are not liable for any loss, inconvenience, delay, or inability to access the Services resulting from account review, fraud prevention, abuse detection, payment verification, or enforcement of these Terms.

18.Prohibited Uses

You agree not to use the Services for any unlawful, unauthorized, abusive, harmful, deceptive, or commercially exploitative purpose. You may not:
  1. 1Scrape, crawl, harvest, extract, download, copy, index, mirror, or aggregate data from the Services;
  2. 2Use bots, scripts, automation, browser extensions, headless browsers, data-mining tools, or unauthorized API calls;
  3. 3Reverse engineer, decompile, disassemble, or attempt to discover source code, models, prompts, scoring logic, algorithms, or system architecture;
  4. 4Resell, sublicense, redistribute, publish, display, transfer, or commercially exploit reports or data without written permission;
  5. 5Use the Services to build, train, benchmark, improve, or support a competing product or service;
  6. 6Circumvent usage limits, access controls, paywalls, security measures, or technical restrictions;
  7. 7Create multiple accounts to obtain extra trials, discounts, reports, credits, or promotional benefits;
  8. 8Submit false, misleading, stolen, unauthorized, or fraudulent payment information;
  9. 9Engage in chargeback abuse or payment manipulation;
  10. 10Use the Services for FCRA-regulated purposes;
  11. 11Use the Services to violate privacy, consumer protection, intellectual property, anti-spam, cybersecurity, export, sanctions, or other laws;
  12. 12Upload or transmit malware, viruses, harmful code, or disruptive content;
  13. 13Attempt to gain unauthorized access to systems, accounts, data, or networks;
  14. 14Interfere with service performance, security, availability, or integrity;
  15. 15Misrepresent your relationship with VinScanPro;
  16. 16Use VinScanPro branding without written permission;
  17. 17Use reports in a misleading, defamatory, fraudulent, or deceptive manner;
  18. 18Harass, threaten, abuse, or harm our personnel, contractors, vendors, users, or partners.
Violation of this section may result in immediate suspension or termination without refund.

19.Commercial Use

Unless you have entered into a separate written commercial, dealer, partner, reseller, API, affiliate, or enterprise agreement with VinScanPro, the Services are licensed only for individual, non-transferable use according to the plan purchased. Businesses, dealerships, affiliates, marketplaces, inspection companies, repair shops, lenders, fleet operators, lead-generation businesses, software platforms, and other commercial users must obtain written authorization before using the Services for business operations, resale, customer-facing reports, integrations, bulk lookup, automated workflows, or commercial distribution. We reserve the right to determine whether usage is personal or commercial based on usage volume, account behavior, business identifiers, payment information, domain names, report patterns, or other reasonable indicators.

20.Third-Party Providers and Data Sources

The Services may rely on third-party providers, vendors, APIs, payment processors, data licensors, government databases, private databases, public records, commercial data sources, AI model providers, hosting providers, analytics providers, email providers, and other external services. We are not responsible for third-party data quality, uptime, delays, pricing changes, restrictions, errors, omissions, outages, discontinuation, or changes in availability. Third-party providers may impose restrictions on how data may be accessed, displayed, stored, used, or redistributed. You agree not to use any data obtained through VinScanPro in a way that would violate these Terms or any applicable third-party restrictions. We may add, remove, replace, suspend, or modify third-party providers or data sources at any time without liability.

21.Vehicle Report Availability

Not all vehicles, VINs, model years, makes, states, titles, records, recalls, auctions, accidents, repairs, theft events, salvage events, total-loss events, odometer readings, service records, market listings, or other data points are available. Some VINs may produce limited results. Some vehicles may have no available history. Some records may appear after a delay. Some records may be removed, corrected, updated, duplicated, or contradicted by later information. We do not guarantee that a report will include any specific category of data. The absence of information in a report does not mean the absence of problems with the vehicle.

22.Errors, Corrections, and Data Disputes

If you believe a report contains inaccurate or incomplete information, you may contact us at support@vinscanpro.com. We may review the issue, request additional information, refer you to the relevant data source, update our display, issue a replacement report, or take other action in our discretion. However, we do not guarantee that third-party data can be corrected, removed, modified, or updated. VinScanPro is not the original source of most vehicle history records and may not have authority to modify official records, third-party records, state records, insurance records, auction records, salvage records, or other external data. You are responsible for contacting the appropriate DMV, insurer, auction, law enforcement agency, manufacturer, dealer, lender, repair facility, or data source if you need an official correction.

23.Account Security

You are responsible for protecting your account credentials and devices. You agree to notify us promptly if you suspect unauthorized access, compromised credentials, fraudulent activity, or unauthorized payment activity. We are not responsible for losses caused by your failure to secure your account, email, device, browser, payment method, or network. We may require password resets, verification codes, account review, or additional authentication if we suspect security risks.

24.Electronic Communications

By using the Services, you consent to receive electronic communications from us, including transactional emails, account notices, billing notices, renewal notices, service updates, support messages, security alerts, policy updates, and legal notices. You agree that electronic communications satisfy any legal requirement that such communications be in writing. You are responsible for keeping your email address current and for monitoring your inbox, spam folder, and account dashboard for notices.

25.Chargebacks and Payment Disputes

If you believe a charge was made in error, you agree to contact us first at support@vinscanpro.com so we can attempt to resolve the issue. We reserve the right to suspend, restrict, or terminate accounts associated with unresolved payment disputes, chargebacks, fraudulent charges, unauthorized payment claims, excessive refund requests, or payment abuse. If a chargeback is filed after digital services, report access, or subscription benefits have been provided, we may provide evidence to the payment processor showing account activity, checkout disclosures, IP/device information, report generation, login activity, cancellation status, and other relevant records. You remain responsible for all legitimate charges incurred under your account.

26.Intellectual Property

The Services, website, reports, report layouts, dashboards, text, graphics, logos, icons, designs, software, workflows, user interface, data presentation, scoring systems, AI prompts, analysis structures, business methods, trademarks, service marks, trade names, copyrights, and other materials are owned by VinScanPro or its licensors and are protected by intellectual property laws. Subject to your compliance with these Terms, VinScanPro grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your permitted personal or authorized business use. You may not copy, reproduce, modify, adapt, translate, sell, rent, sublicense, distribute, publish, create derivative works from, publicly display, publicly perform, or commercially exploit any part of the Services without our prior written permission. All rights not expressly granted are reserved by VinScanPro.

27.Trademarks

"VinScanPro," "Decision Engine," "Smart Buy Analysis," "Deal Radar," related names, logos, slogans, graphics, trade dress, and product names are trademarks, service marks, or brand assets of VinScanPro or its affiliates, whether registered or unregistered. You may not use our marks in any manner likely to cause confusion, imply endorsement, misrepresent affiliation, or damage our reputation without our prior written consent.

28.User Content and Feedback

If you submit reviews, messages, support requests, screenshots, VINs, vehicle details, dispute materials, suggestions, feedback, ideas, comments, or other content to us, you grant VinScanPro a worldwide, non-exclusive, royalty-free, sublicensable, transferable license to use, reproduce, store, process, display, modify, and create derivative works from such content as reasonably necessary to operate, improve, support, secure, market, and provide the Services. You represent and warrant that you have the right to submit any content you provide and that such content does not violate any law, third-party right, privacy right, intellectual property right, or contractual obligation. You agree that we may use suggestions, ideas, or feedback without compensation or obligation to you.

29.Privacy

Our collection, use, storage, and sharing of personal information are described in our Privacy Policy. By using the Services, you consent to our handling of information as described in the Privacy Policy. You acknowledge that no method of transmission or storage is completely secure and that we cannot guarantee absolute security of information.

30.Service Availability and Modifications

We may modify, update, suspend, discontinue, replace, restrict, or remove any part of the Services at any time, with or without notice. We do not guarantee that the Services will be uninterrupted, error-free, secure, available, compatible with your device, or free from defects. Service interruptions may occur due to maintenance, updates, security incidents, third-party outages, hosting issues, data-provider issues, internet problems, payment processor issues, force majeure events, or other causes. We are not liable for any unavailability, interruption, delay, loss of data, loss of access, or inability to generate or view reports.

31.Beta Features and Experimental Tools

We may offer beta, experimental, preview, pilot, or early-access features. Such features may be incomplete, inaccurate, unstable, discontinued, modified, or removed at any time. Beta features are provided "as is" and without warranties of any kind. You use them at your own risk.

32.Termination and Suspension

We may suspend, restrict, or terminate your access to the Services at any time if we believe, in our sole discretion, that:
  1. 1You violated these Terms;
  2. 2You created risk or potential legal exposure for VinScanPro;
  3. 3Your payment failed or was disputed;
  4. 4Your account appears fraudulent, abusive, automated, or unauthorized;
  5. 5Your usage exceeds permitted limits;
  6. 6Your activity threatens the security, integrity, reputation, or availability of the Services;
  7. 7We are required to do so by law, provider restriction, payment processor requirement, court order, or government request;
  8. 8Continuing to provide Services to you is commercially, technically, legally, or operationally impractical.
Unless required by law or expressly stated in our Refund Policy, you are not entitled to a refund, credit, or compensation if your account is suspended or terminated due to violation of these Terms. Sections that by their nature should survive termination shall survive, including payment obligations, intellectual property, disclaimers, limitation of liability, indemnification, arbitration, governing law, and dispute provisions.

33.Disclaimer of Warranties

To the maximum extent permitted by law, the Services are provided on an "as is," "as available," and "with all faults" basis. VinScanPro disclaims all warranties, express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, completeness, availability, reliability, security, and uninterrupted operation. We do not warrant that:
  1. 1Reports will be accurate, complete, current, or available;
  2. 2Any vehicle is safe, reliable, legal, insurable, financeable, or worth purchasing;
  3. 3Any AI-powered analysis will be correct, complete, or suitable for your needs;
  4. 4The Services will meet your expectations;
  5. 5The Services will be uninterrupted, timely, secure, or error-free;
  6. 6Defects will be corrected;
  7. 7Third-party data will be accurate, complete, or available;
  8. 8Any specific record, accident, title brand, odometer event, recall, theft record, auction record, service record, or other data point will appear in a report.
You assume all risk arising from your use of the Services and reliance on any information provided through the Services.

34.Limitation of Liability

To the maximum extent permitted by law, VinScanPro and its owners, officers, directors, managers, members, employees, contractors, vendors, licensors, data providers, affiliates, successors, and assigns shall not be liable for any indirect, incidental, consequential, special, exemplary, enhanced, punitive, or similar damages, including lost profits, lost revenue, lost savings, loss of data, loss of business opportunity, loss of goodwill, vehicle purchase losses, repair costs, financing losses, insurance issues, registration issues, title issues, diminution in value, failed transactions, or damages arising from reliance on reports or AI-powered analysis. To the maximum extent permitted by law, VinScanPro's total aggregate liability for all claims arising out of or relating to the Services, these Terms, any report, any subscription, any transaction, or any website use shall not exceed the greater of:
  1. 1The amount you paid to VinScanPro for the specific Service giving rise to the claim during the three months before the claim arose; or
  2. 2One hundred U.S. dollars.
The limitations in this section apply regardless of the legal theory, whether based on contract, tort, negligence, strict liability, statute, warranty, misrepresentation, consumer protection law, or any other theory, even if we have been advised of the possibility of such damages. Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you. In such cases, liability is limited to the maximum extent permitted by law.

35.Indemnification

You agree to defend, indemnify, and hold harmless VinScanPro and its owners, officers, directors, managers, members, employees, contractors, vendors, licensors, data providers, affiliates, successors, and assigns from and against any claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses, including reasonable attorneys' fees, arising out of or relating to:
  1. 1Your use or misuse of the Services;

  4. 4Your reliance on any report or AI-powered analysis;
  5. 5Your purchase, sale, financing, insurance, repair, registration, listing, valuation, or rejection of any vehicle;
  6. 6Your user content, submissions, or feedback;
  7. 7Your unauthorized commercial use, resale, scraping, automation, or redistribution of data;
  8. 8Your violation of third-party rights;
  9. 9Any dispute between you and a vehicle seller, buyer, dealer, lender, insurer, mechanic, inspector, DMV, marketplace, or other third party.
We reserve the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.

37.Dispute Resolution; Mandatory Informal Process

Before initiating arbitration, small claims, or any other legal proceeding, you agree to first contact us at support@vinscanpro.com with a written description of your dispute. Your notice must include:

  2. 2The email address associated with your account;
  3. 3A description of the issue;
  4. 4The date and amount of any disputed charge;
  5. 5The VIN or report involved, if applicable;
  6. 6The relief you are requesting;
  7. 7Any supporting documentation.
You and VinScanPro agree to attempt in good faith to resolve the dispute informally for at least 30 days after receipt of the notice.

38.Binding Arbitration

Except for claims that qualify for small claims court or claims seeking injunctive relief for intellectual property misuse, unauthorized access, security abuse, scraping, or data theft, you and VinScanPro agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, any report, any subscription, any payment, any trial, any refund request, any cancellation, any account, any communication, or any relationship between you and VinScanPro shall be resolved by binding individual arbitration. This arbitration agreement is governed by the Federal Arbitration Act. The arbitration shall be administered by a mutually agreed arbitration provider. If the parties cannot agree on a provider, either party may ask a court of competent jurisdiction to appoint a neutral arbitrator. The arbitrator shall have exclusive authority to resolve disputes regarding arbitrability, scope, interpretation, applicability, enforceability, and validity of this arbitration agreement, including any claim that all or part of this arbitration agreement is void or voidable. The arbitration shall take place in Maricopa County, Arizona, unless the parties agree to remote, written, telephone, or video arbitration. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that individual party's claim.

39.Class Action Waiver

You and VinScanPro agree that all disputes must be brought only in an individual capacity and not as a plaintiff, class member, collective member, private attorney general, or representative in any purported class, collective, consolidated, mass, or representative proceeding. Class arbitration, collective arbitration, representative arbitration, private attorney general actions, and consolidated proceedings are not permitted. If a court or arbitrator determines that this class action waiver is unenforceable as to a particular claim or request for relief, then that claim or request for relief shall be severed and brought only in a court of competent jurisdiction, while all remaining claims shall proceed in arbitration.

40.Jury Trial Waiver

To the maximum extent permitted by law, you and VinScanPro knowingly and voluntarily waive any right to a trial by jury in any dispute, claim, or proceeding arising out of or relating to these Terms or the Services.

41.Small Claims and Injunctive Relief

Either party may bring an individual claim in small claims court if the claim qualifies and remains in small claims court. VinScanPro may seek injunctive or equitable relief in court to prevent or stop unauthorized access, scraping, data extraction, intellectual property infringement, misuse of the Services, security threats, fraud, or violation of third-party data restrictions.

42.Governing Law and Venue

These Terms and any dispute arising out of or relating to the Services shall be governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except that the Federal Arbitration Act governs the arbitration agreement. Subject to the arbitration provisions above, any court proceeding shall be brought exclusively in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction and venue in those courts.

43.Time Limit to Bring Claims

To the maximum extent permitted by law, any claim or dispute arising out of or relating to the Services or these Terms must be filed within one year after the claim arises. Any claim not filed within that period is permanently barred. This limitation does not apply where prohibited by law.

44.Force Majeure

VinScanPro shall not be liable for any delay, failure, interruption, data unavailability, or inability to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, government action, court orders, fires, floods, power outages, internet failures, hosting failures, cyberattacks, payment processor outages, third-party provider outages, data-source outages, supply-chain events, or other events beyond our reasonable control.

45.Assignment

You may not assign, transfer, delegate, or sublicense your rights or obligations under these Terms without our prior written consent. We may assign, transfer, delegate, or sublicense our rights and obligations under these Terms in connection with a merger, acquisition, financing, sale of assets, reorganization, change of control, affiliate transfer, or operation of the Services by another entity.

46.Severability

If any provision of these Terms is found invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent as closely as possible.

47.No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by an authorized representative of VinScanPro.

48.Entire Agreement

These Terms, together with the Privacy Policy, Refund Policy, checkout disclosures, plan terms, and any supplemental terms expressly incorporated by reference, constitute the entire agreement between you and VinScanPro regarding the Services. These Terms supersede all prior or contemporaneous communications, understandings, agreements, representations, and warranties relating to the Services.

49.Interpretation

Headings are for convenience only and do not affect interpretation. The words "including," "includes," and similar terms mean "including without limitation." Any reference to "Services" includes all current and future website features, dashboards, reports, tools, subscription features, AI analysis, and related offerings unless the context requires otherwise.
